Rule Summary: The state of Alabama does not have requirements for the licensure or registration of polysomnographic technologists. In statute, Section 34-27B-11 provides that nothing in the chapter regarding the licensure and practice of respiratory therapy “shall be construed as preventing or restricting the practice, services, or activities of . . . [a]ny individual employed as a polysommagraphic [sic] technologist working in a sleep center or diagnostic sleep clinic.”

Rule 798-X-5-.16, Exemptions from Licensure, provides that nothing in the rules regarding the practice of respiratory care shall be construed as preventing or restricting the practice, services, or activities of . . . [a]ny individual employed as a polysomnographic technologist working in a sleep center or diagnostic sleep clinic.”

Rule Summary: The state of Alabama does not have certification requirements for the practice of polysomnographic technologists. California

Rule Summary: California requires that polysomnographic technologists, polysomnographic technicians, and polysomnographic trainees be registered under the California polysomnographic registration program.

Under rule, 16 CCR 4.3, the program has approved polysomnographic educational programs which include the following: (1) a program accredited by either the Commission on Accreditation of Allied Health Education Programs (CAAHEP) or the Commission on Accreditation for Respiratory Care; (2) a sleep technologist program accredited by the American Academy of Sleep Medicine; and (3) a sleep technologist program approved by the Board of Registered Polysomnographic Technologists (BRPT). In addition, the Board has approved the certification examination offered by BRPT (also see Business and Professional Code Section 3575).

The Medical Board regulates the registration program in the state.  The Board is required to have 15 members that include physicians and public members. There is no requirement to have a polysomnographic professional on the Board.

Rule Summary: The District of Columbia requires licensure to practice polysomnography. There are two levels of licensure, the highest level being that of polysomnographic technologist. The lower tier of licensure is polysomnographic technician.

Rule Summary: Idaho requires polysomnographic technologists to be permitted in the state. The state requires that polysomnographic technologist must complete the certification examination administered by the Board of Registered Polysomnographic Technologists (BRPT). The state allows individuals to provide polysomnography related respiratory care services.

The Board of Medicine and Respiratory Care Board regulates the professional respiratory therapists and polysomnography technologists. The Board consists of five (5) members, one (1) of whom is a licensed respiratory care practitioner and also a registered polysomnography technologist. (see IDAPA 22.01.11.011)

Under Idaho Statute 54-4304A, the qualifications for a permit requires that the applicant submit an application to the licensure board as required by the rules and pay the applicable fees under the law. A registered polysomnographic technologist must complete the certification examination administered by the Board of Registered Polysomnographic Technologists (BRPT) or an equivalent examination approved by the Board. The polysomnographic technician applicant must complete a polysomnography program with a licensed or nationally accredited educational facility. Applicant must complete a minimum of seven hundred and twenty (720) hours of training experience. In addition, the state rules, IDAPA 22.01.11.032.05(e)(iii) for a polysomnographic trainee requires that the trainee complete twenty-four (24) semester credit hours of postsecondary education at a licensed or nationally accredited facility. Under, IDAPA 22.01.11.032(f)(vi), the applicant for renewal of a permit must show proof of completion of no less than twelve (12) hours of approved continuing education addressing polysomnographic-related respiratory care per year. Finally, the Board has established dual licensure/permit fees for practitioners of respiratory and polysomnographic-related respiratory care.

Rule Summary: Louisiana has licensure requirements for polysomnographic technologists.  Under Louisiana Revised Statutes (RS) Chapter 36-B, Section 2865, applicants for licensure must have a registered polysomnographic technologist credential granted by BRPT or an equivalent organization approved by the State Board of Medical Examiners (Board).   Beginning 7/1/2013, applicants must also graduate from program accredited by Commission on Accreditation of Allied Health Education Programs and pass an examination administered as a component of a certification program accredited by the National Commission for Certifying Agencies, the American National Standards Institute, or other accrediting organization approved by the Board.  Polysomnographic technologists seeking to renew their license must complete at least ten hours of continuing education in twelve months prior to submitting their application for renewal.

Louisiana has an Advisory Committee on Polysomnography (Committee) which assists the Board on matters related to polysomnographic technologists. The Committee was created by RS Chapter 36-B Chapter 2864.  Four members of the Committee must be licensed polysomnographic technologists registered by BRPT and be selected by the governor from a list of eight names submitted by the Louisiana Academy of Sleep Medicine.

Rule Summary: The state of Maryland requires polysomnographic technologists to be licensed by 10/1/2013. Statutory requirements for licensure are found in MD Code Ann., Health Occupations §14–5C and the administrative rules are found at COMAR 10.32.06.

Maryland law requires polysomnographic technologists to be credentialed in order to obtain licensure. MD Code Ann., Health Occupations §14–5C–09 sets for credential and education standards. It requires polysomnographic technologists to pass BRPT's national certifying exam, or another exam approved by the Maryland Board of Physicians. It also requires completion of accredited polysomnographic or respiratory care educational program. The Board may waive the education requirement for applicants who apply by 9/30/2013, however, the BRPT credential requirement may not be waived.

The Maryland Board of Physicians has a Polysomnography committee that governs the licensure and practice of polysomnography. This committee is required by MD Code Ann., Health Occupations §14–5C–06, and governed by COMAR 10.32.06.03. The membership of this committee is comprised of three physicians, three polysomnographic technologists, and one consumer.

Rule Summary: The state of Maryland requires licensure of polysomnographic technologists. The deadline for licensure is 10/1/2013. Licensure requirements are described in detail at MD8303. Passage of the BRPT certification exam is required for practice and licensure.

Under state law, N.J.S.A. 45:14G-10 (a) the board "shall issue a license as a polysomnographic technologist to any applicant who the board determines to be qualified to perform the duties of a polysomnographic technologist. In making a determination, the board shall review evidence that the applicant has successfully completed the board's requirements for education; training; and experience, with documented proficiencies, determined using standards established by the board at least commensurate with national Association of Polysomnographic Technologists or American Academy of Sleep Medicine standards; and has successfully completed the certification examination administered by the Board of Registered Polysomnographic Technologists or its successor, or any other examination testing polysomnography approved by the board. The fee prescribed by the board shall accompany the application."  The Board has approved the RST Examination given by the American Academy of Sleep Medicine (AASM).

The State Board of Polysomnography regulates the professions in New Jersey. Per state law, N.J.S.A 45:14G-4, the board is required to have 11 members, 6 of whom must be licensed polysomnographic technologists.  Under rule N.J.A.C. 13:44L-4.1, the Board requires that polysomnography professionals "complete a minimum of twenty (20) continuing education (CE) hours."  The professions must complete CE hours recognized by the BRPT Education Advisory Board (BRPT-EAC), the AASM, the AAST, the American Society of Electroneurodiagnostic Technologists, Inc. (ASET), the American Association for Respiratory Care (AARC), the American Nurses Association (ANA), the American Medical Association (AMA), the American College of Chest Physicians (ACCP) and the American Physical Therapy Association (APTA).

To meet the professional education requirement for authorization as a polysomnographic technologist in the State, the applicant shall present evidence of the completion of an associate or higher degree in polysomnographic technology: (a) in a program registered by the department; or (b) in a program determined by the department to be substantially equivalent to a registered program; or (b) completion of a course of study which is substantially equivalent to a program determined to be satisfactory to the department. Scope of Practice

The practice of polysomnographic technology means the process of collecting, analyzing, scoring, monitoring and recording physiologic data during sleep and wakefulness to assist the supervising physician in the clinical assessment and diagnosis of sleep/wake disorders and other disorders, syndromes and dysfunctions that either are sleep related, manifest during sleep or disrupt normal sleep/wake cycles and activities.

The practice of polysomnographic technology includes the non-invasive monitoring, diagnostic testing, and initiation and delivery of treatments to determine therapeutic levels of inspiratory and expiratory pressures for individuals suffering from any sleep disorder, as listed in an authoritative classification of sleep disorders acceptable to the department, under the direction and supervision of a licensed physician who is available for consultation at all times during the provision of polysomnographic technology services in any setting (§79-4.8).  Section §79-4.8 also provides specific practice details which can be conducted by a technologist.

Under North Dakota Administrative Code Section 150-04-01-01, the Board requires an applicant to submit a copy of a certificate from the Board of Registered Polysomnographic Technologists or other nationally accredited body approved by the Board. North Dakota Administrative Code Section 105-04-01-05 provides that "the successful passing of a national examination means obtaining a score equal to or greater than the passing score, which is in effect at the time of the administration of the test, established by the Board of Registered Polysomnographic Technologists or its successor, as recognized by the Board."

North Dakota Administrative Code Section 105-04-01-04 requires licensees to complete ten clock hours of continuing education approved by the Board. The Board has the authority to accept programs sponsored by an organization appropriate to provide continuing education, and it provides the Board of Registered Polysomnographic Technologists as an example of such an organization.

(b) The person performing the tasks does not represent that the person is engaged in the practice of respiratory care.

The following respiratory care tasks performed in the diagnosis and therapeutic intervention of sleep-related breathing disorders may be performed upon the prescription or order under the general supervision of a physician:
(1) Application and titration of bi-level or continuous positive airway pressure;
(2) Application and titration of supplemental low flow oxygen;
(3) Application and monitoring of pulse oximetry;
(4) Application and monitoring of capnometry; and
(5) Patient education in the application of bi-level or continuous positive airway pressure, low flow oxygen, or pulse oximetry for the ongoing management of sleep-related disorders.

The Committee consists of seven members, appointed by the Governor and is composed of the following: three registered polysomnographic technologists; one physician who is certified in sleep medicine by a national certifying body recognized by the American Academy of Sleep Medicine; one person who is the director of an accredited, hospital-based sleep center; one respiratory therapist who is also a registered polysomnographic technologist; and one consumer member who is not commercially or professionally associated with the health care field. A polysomnographic technologist a person who is credentialed by the board of registered polysomnographic technologists and is licensed by the board to engage in the practice of polysomnography under the general supervision of a licensed physician. (Tenn Code Ann. 63-31-101)

Education Requirements

A polysomnographic technologist must comply with State procedures and documentation for the initial licensure. The applicant complete and obtain a passing score on the national certifying exam
given by the BRPT within twelve months of applying for initial licensure. The procedures are detailed in Rule 0880-14-.03.  A license holder must complete ten hours of continuing education every calendar year. (Rule 0880-14-.09)

Scope of Practice

The practice of polysomnography means the staging and scoring of sleep by continuous and simultaneous monitoring of the stages of sleep and wake through use of an electroencephalogram (EEG), an electroculogram (EOG) and a submental electromyogram (EMG), in conjunction with the recording and monitoring of other physiological variables, and the assignment of values for duration, frequency and type of event to each stage of sleep in which the event occurred. (Tenn. Code Ann 63-31-101). Tenn. Code Ann. 63-31-101 also describes in detail the practices a polysomnograhic technologists is permitted to perform.

Rule Summary: Washington does not regulate polysomnographic technologists.  The state has established general practice requirements for a respiratory care practicer that include polysomnographic practice.  Under state law, RCW 18.89.040 the "practice of respiratory care includes: (l) Diagnostic monitoring of and therapeutic interventions for desaturation, ventilatory patterns, and related sleep abnormalities to aid the health care practitioner in diagnosis. This subsection does not prohibit any person from performing sleep monitoring tasks as set forth in this subsection under the supervision or direction of a licensed health care provider. "
